Compliance Review and Import Procedures for Textiles

With the passage of Public Law 103-82, Title VI, the Customs Modernization (Mod) Act was enacted. Regulations enforcing the provisions of the Act are currently being adopted. Customs' new position is compared to the Internal Revenue Service, which has the option of asking for full audits on a selective basis.
What the Mod Act can mean to an Importer?
  • The onus of proper classification and valuation increasingly is the responsibility of the importer of record under the standard of "reasonable care" (19 U.S.C. 1484). 
  • Stiffer penalties for levels of culpability (negligence, gross negligence, fraud) can now be imposed by Customs - in addition to liquidated damages for improper classifications. 
  • Section 615G penalties for failure to comply with a lawful demand for records can now be imposed.
